1. Purpose

These Terms of Use govern access to and use of the client portal made available by Artdantech to its clients in connection with active service engagements.

Accessing the client portal constitutes full and unconditional acceptance of these Terms of Use.

2. Access

Access to the client portal is restricted to Artdantech clients with an active account, created by Artdantech upon commencement of a service engagement.

Access is granted for the duration of the contractual relationship. Upon termination or end of service, Artdantech reserves the right to deactivate the account within 30 days, following email notification.

Users are solely responsible for maintaining the confidentiality of their login credentials.

3. User Account

• Access is strictly personal and non-transferable.
• Sharing login credentials is prohibited.
• The user is responsible for all activity carried out under their account, including in the event of unauthorised access resulting from their own negligence.
• Any suspected unauthorised access must be reported immediately to contact@artdantech.com.

4. Features

The client portal provides access to the following services:

• SEO dashboard — rankings, traffic, Core Web Vitals
• Document centre — invoices and quotes
• Dedicated messaging with the Artdantech studio
• Access to negotiated partner offers

These features may evolve over time. Artdantech will notify users of any significant changes by email with at least 15 days' notice.

5. Data & Metrics

The data displayed in the client portal (SEO rankings, traffic, Core Web Vitals, performance scores) is sourced from third-party services, including Google Search Console and Google PageSpeed Insights.

This data is provided for informational purposes only and may be subject to update delays or discrepancies between tools. It does not constitute a contractual commitment to specific results.

Artdantech cannot be held liable for any interruption or inaccuracy resulting from a third-party service failure.

6. Ownership of Client Data

Data entered by the user in the client portal (messages, uploaded documents) remains the property of the user. Artdantech makes no commercial use of this data.

This data is used solely for the purpose of delivering the contracted services and is processed in accordance with our Privacy Policy.

7. Messaging

Users agree to use the messaging feature in a professional and lawful manner, without sending unlawful, abusive, defamatory or otherwise inappropriate content.

Exchanges via the messaging feature do not constitute contractual amendments unless formally confirmed in writing by Artdantech.

8. Availability

The service is available 24/7, subject to interruptions required for maintenance or resulting from events beyond Artdantech's reasonable control.

Artdantech will endeavour to notify users of planned maintenance with reasonable advance notice.

9. Liability

Artdantech cannot be held liable for any interruptions, errors or data loss arising from use of the service, hosting failures or third-party service disruptions.

In any event, Artdantech's liability is capped at the net amount paid for the active service engagement at the time of the incident.

10. Third-Party Services

Certain features of the client portal rely on third-party services, including Google Search Console, Google PageSpeed Insights, invoicing tools and messaging infrastructure.

Artdantech cannot be held liable for the availability, accuracy or continuity of these third-party services.

11. Artificial Intelligence

The client portal may include features assisted by artificial intelligence. In accordance with the EU AI Act (Regulation 2024/1689), any AI-assisted functionality is clearly identified as such within the interface.

Responses and recommendations generated by AI are provided for informational purposes only. They do not constitute professional advice (legal, financial or technical) and are not binding on Artdantech.

The user remains solely responsible for any decisions made on the basis of AI-generated content.

12. Security

Users agree not to attempt to compromise the security of the service, disrupt its operation or gain unauthorised access by any means.

In the event of a security incident affecting users' personal data, Artdantech commits to notifying affected individuals within 72 hours, in accordance with Article 33 of GDPR.

13. Account Suspension

Artdantech reserves the right to suspend or deactivate an account in the event of:

• breach of these Terms of Use,
• abusive or fraudulent use of the service,
• persistent non-payment on the associated engagement,
• termination of the contractual relationship.

Suspension will be notified by email with 7 days' notice, except in cases of emergency or serious breach.

14. Amendments

Artdantech reserves the right to amend these Terms of Use at any time. Any material change will be notified by email with a minimum of 15 days' notice before taking effect.

Continued use of the service after this period constitutes acceptance of the updated Terms.

15. Governing Law

These Terms of Use are governed by French law, regardless of the user's country of residence or establishment.

In the event of a dispute, and in the absence of an amicable resolution, exclusive jurisdiction is granted to the courts of Paris, France.
